Process Serving Via Social Media- Is This Possible?

We currently live in a society that is consistently progressing in every way imaginable. It is quite amazing to see how far we have come in regards to the technology that we use on a daily basis.

Social media platforms have become widely popular all around the world. Individuals are able to keep in touch with their friends in an instant on Facebook, Twitter, Instagram, and other social media platforms. However, what would one think if they were receiving messages that included legal documents?

Today we are going to discuss if it is possible for process serving to happen via social media and the possible effects (both good and bad).

Let's refresh-what is process serving? 

Process serving is the task of an individual delivering legal documents in regards to a court case. Before social media platforms even existed, the only way for a court (or legal individual) could serve someone these documents would be to physically hand it to them at their home of residence.

However, now that technology has advanced tremendously (including social media) the question of is this possible has two distinct options.

What are the benefits of this being possible?

When a business or individual is looking to serve another individual court papers, if they see it on social media, more times than not you can see when the person “reads” the message. For those that are pretty conscious about conserving paper and natural resources, this will be a great option.

What are the negative aspects of this happening?

As with everything that is surrounded by technology, there are also negative aspects of acknowledging. Process serving via social media can cause a lot of problems for our court systems. In all actuality, an individual can simply delete their social media account and make a new one if they want to simply avoid the situation. It would be very difficult to also pinpoint exactly who is who on social media.

Many common names can be mixed up and in the worse case scenario have important (and highly sensitive) information passed on to the wrong person. While technology has helped improve our daily lives, safety and security are still of the utmost importance.
