Subpoena -

A subpoena is different from a court order.

A HIPAA-covered provider or plan can disclose information only if the subpoena abides by the Privacy Rule. Before, there should be proof of reasonable efforts to:

  1. Notify the person who is the subject of the information about the request to give them an opportunity to object.
  2. Attempt a protective order for the information from the court.

Serving an individual at a government facility

If it is a personal matter involving an employee of the Health and Human Services, they must be personally served. Serving a subject personally at this location can be extremely difficult if the subject to be served is unwilling to receive. Security will stop us from entering and must know the reason for service.
